Privacy Policy

Emmaus Homes is committed to maintaining your confidence and trust, and accordingly maintains the following privacy policy to protect personal information you provide online.

Commitment to Online Security
Physical, electronic and managerial procedures have been employed to safeguard the security and integrity of personal information. Financial information is encrypted whenever transmitted or received online. Personal information is accessible only by staff and designated volunteers. All Emmaus agents and contractors with access to personal information obtained on the Emmaus web site are also bound to adhere to this policy.

Personal Information that Emmaus May Collect Online
Emmaus collects the following types of personal information: names, postal and e-mail addresses, phone and facsimile numbers and billing information. Emmaus does not collect or maintain information from those actually known to be under the age of 13, and no part of our site is structured to attract anyone under the age of 13.

How Emmaus May Use Personal Information Collected Online
Emmaus will not use your personal information other than for the purpose for which it was submitted without your consent. We use personal information to maintain mailing lists for our newsletter and e-newsletter, for advocacy mailings and for event registrations. At certain points where personal information is collected on our site, there may be a box where you may indicate you would like to be on a list to receive information about other Emmaus programs and services and about ways to support the Emmaus mission. At any time you can add or remove your name from our mailing list by contacting us at goforthalyson@emmaushomes.org.

How Your Information May Be Shared
Emmaus never sells or rents personal information. Text messaging opt-in data and consent will not be shared with any third party.

Computer Tracking and Cookies
Our web site is not set up to track, collect or distribute personal information not entered by its visitors. Our site logs do generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our site. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information.

Title VI Notice

Notifying the Public of Rights under Title VI
Emmaus Homes, Inc. (“Emmaus”) posts Title VI notices on our agency’s website and in public areas of our agency.
Emmaus operates its programs and services without regard to race, color, or national origin, in accordance with Title VI of the Civil Rights Act of 1964.If you believe you have been discriminated against on the basis of race, color, or national origin by Emmaus, you may file a Title VI / ADA complaint by completing, signing, and submitting the agency’s Title VI / ADA Complaint Form.

How to file a Title VI / ADA complaint with Emmaus:

  1. Complaint Forms may be obtained online at www.emmaushomes.org, in-person at Emmaus’ corporate office located at 3731 Mueller Road, St. Charles, Missouri 63301, or by calling 636-534-5200.
  2. In addition to the complaint process at Emmaus, complaints may be filed directly with the Federal Transit Administration Office of Civil Rights, Attention: Title VI Program Coordinator, East Building, 5th Floor – TCR, 1200 New Jersey Avenue SE, Washington, DC 20590.
  3. Complaints must be filed within 180 days following the date of the alleged discriminatory occurrence and should contain as much detailed information about the alleged discrimination as possible.
  4. The form must be signed and dated, and include your contact information.If information is needed in another language, contact 636-534-5200.

Procedures for Filing a Title VI / ADA Complaint
The complaint procedures apply to the beneficiaries of Emmaus’ programs, activities, and services.

RIGHT TO FILE A COMPLAINT: Any person who believes they have been discriminated against on the basis of race, color, or national origin by Emmaus may file a Title VI / ADA complaint by completing and submitting the agency’s Title VI / ADA Complaint Form. Title VI / ADA complaints must be received in writing within 180 days of the alleged discriminatory complaint.

or request a copy by writing to Emmaus Homes, Inc., Attention: Corporate Compliance Officer, 3731 Mueller Road, St. Charles, MO 63301. Information on how to file a Title VI / ADA complaint may also be obtained by calling Emmaus’ corporate compliance officer at 636-534-5200.

You may file a signed, dated complaint no more than 180 days from the date of the alleged incident. The complaint should include:
– Your name, address and telephone number.
– Specific, detailed information (how, why and when) about the alleged act of discrimination.
– Any other relevant information, including the names of any persons, if known, the agency should contact for clarity of the allegations.

Please submit your complaint form to Emmaus Homes, Inc., Attention: Corporate Compliance Officer, 3731 Mueller Road, St. Charles, MO 63301.

COMPLAINT ACCEPTANCE: Emmaus will process complaints that are complete. Once a completed Title VI / ADA Complaint Form is received, Emmaus will review it to determine if Emmaus has jurisdiction. The complainant will receive an acknowledgement letter informing them whether or not the complaint will be investigated by Emmaus.

INVESTIGATIONS: Emmaus will generally complete an investigation within 90 days from receipt of a completed complaint form. If more information is needed to resolve the case, Emmaus may contact the complainant. Unless a longer period is specified by Emmaus, the complainant will have ten (10) days from the date of the letter to send requested information to the Emmaus investigator assigned to the case. If the requested information is not received within that timeframe the case will be
closed. Also, a case can be administratively closed if the complainant no longer wishes to pursue the case.

LETTERS OF CLOSURE OR FINDING: After the Title VI investigator reviews the complaint, the Title VI investigator will issue one of two letters to the complainant: a closure letter or letter of finding (LOF).
– A closure letter summarizes the allegations and states that there was not a Title VI violation and that the case will be closed.
– A Letter of Finding (LOF) summarizes the allegations and provides an explanation of the corrective action taken.

If the complainant disagrees with Emmaus’ determination, the complainant may request reconsideration by submitting the request in writing to the Title VI investigator within seven (7) days after the date of the letter of closure or letter of finding, stating with specificity the basis for the reconsideration. Emmaus will notify the complainant of the decision either to accept or reject the request for reconsideration within ten (10) days. In cases where reconsideration is granted, Emmaus will issue a determination letter to the complainant upon completion of the reconsideration review.

A person may also file a complaint directly with the Federal Transit Administration, at the FTA Office of Civil Rights, 1200 New Jersey Avenue SE, Washington, DC 20590.

HIPAA Policy

The following is the Notice of Privacy Practices (NPP) for Emmaus Homes, Inc. This NPP is directed toward all Emmaus
Homes clients and their guardians. Therefore, “you” refers to Emmaus Homes’ clients and/or guardians.

Notice of Privacy Practices Effective date: April 14, 2003 – Revision date: June 14, 2005

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
We are required by the Federal Health Insurance Portability and Accountability Act (HIPAA) to follow the practices described in this pamphlet. This notice applies to protected health information (PHI) that we have about you and which is kept in or by Emmaus Homes. With some exceptions, we must obtain your authorization to disclose (or release) your health care information. There are some situations in which we do not have to obtain your authorization. This Notice of Privacy Practices does not cover every possible use or disclosure. If you have any questions, please contact one of Emmaus Homes’ Privacy Officers listed at the end of this brochure. Examples of Protected Health Information: Name, address, telephone number, electronic mail address, social security number, medical record number, health plan number, account number, full face photographic images, any recorded or verbal health-related information.

Who has access to your personal information? Employees of Emmaus Homes and/or Business Associates who have a need to know or to disclose the information in order to provide treatment and services, billing for services or health care operations.

Without your authorization, we may use your personal information:
• To plan your treatment and services
• To process bills for payment, or to obtain advance approval from your insurance, Medicaid, medicare, or third party payers.
• To exchange information with State entities such as Social Security, Social Services, Department of Health and Senior Services, Department of Mental Health, etc.
• To treat you in an emergency.
• To treat you when there is something that prevents us from communicating with you.
• To inform you about possible treatment options.
• For agencies involved in a disaster situation.
• As required by State, Federal, or local law. This includes investigations, Audits, inspections, and licensure.
• When ordered to do so by a court in judicial and administrative proceedings.
• In cooperation with law enforcement in investigation of commit a crime.
• To communicate with coroners, medical examiners, and funeral homes, when necessary for them to do their jobs.
• To communicate with federal officials involved in security activities authorized by law.
• For public health needs such as control of infectious diseases.
• For purposes of research as approved by Human Rights Committee.
• Oversight of our health care delivery system.
• For National Defense and security.
• For quality assurance audits.
• Inclusion in facility directories.
• To share needed information for pocessing payment for health care services.

Uses or disclosures not covered in this Notice of Privacy Practices will not be made without your written authorization. If you provide us written authorization to use or disclose information, you can change your mind and revoke your authorization, we will no longer disclose the information. What are your rights?
1. Access to and copies of Protected Health Information.
2. To appeal if we decide not to let you see all or some parts of your record.
3. To ask for the record to be changed if you believe you see a mistake or something that is not complete.
You must make this request in writing. We may deny your request if:
o We did not create the entry that is wrong.
o The information is not part of the file that we would let you see/.
o We believe the record is accurate and complete.
4. To know to whom we have released information about you up to last six years, other than
permitted disclosures for treatment, billing or health care operations as described in this notice. The
first request in a 12-month period is free. We may charge you for additional requests.
5. To request that we limit how we use or disclose information about you. This must be made in writing,
and we are not required to agree to the request.
6. To ask that we communicate with you about medical matters in a certain way or at a certain location.
This request must be made in writing.
7. To authorize other releases of your personal information not described previously. You may change
your mind and remove the authorization at any time (in writing).
8. To have a paper copy of the Notice of Privacy Practices.
9. To file a complaint with us or with the Secretary of the Department of Health and Human Services if
you believe any of your rights have been violated. All complaints must be in writing. You will not be
penalized if you file a complaint.
10. We reserve the right to change this notice. We may make the revised notice effective for health
information we already have about you as well as any we received in the future.
